Purpose & Authority:
Under Michigan law, the ZBA provides fair interpretation and application of zoning rules on a case-by-case basis. It hears appeals of administrative decisions, issues official interpretations of the zoning ordinance, and grants dimensional variances. These safeguards maintain community standards while addressing unique property situations.
Board Establishment:
Derived from the Michigan Zoning Enabling Act (P.A. 110 of 2006, MCL 125.3601–3607 Required in every municipality or substituted by the city council under certain rules.
Membership:
- Regular Members: Minimum 5 appointed by the council. City residency required; demographics should reflect the city.
- Alternates: Appointed to fill in as needed.
- Terms & Attendance: Typically, 3-year terms; quorum needed per bylaws.
- Compensation
& Removal: Per-Diem
expenses may be provided; removal for cause is permitted after proper
hearing procedures.
